Une fois de plus, le Parlement Polonais cherche à restreindre les droits reproductifs des femmes en Pologne. Cette semaine, il débat d’un nouveau projet de loi intitulé «Stop à l’avortement». S’il est adopté, ce projet de loi limitera encore davantage les motifs déjà très restreints qui permettent aux femmes d’accéder légalement à l’avortement : s’il y a danger pour la vie ou la santé des femmes ; dans des situations de malformation fœtale grave ; lorsque la grossesse résulte d’un viol ou d’un inceste. Il interdira désormais l’avortement en cas de grave anomalie fœtale. Or, les statistiques officielles de 2016 montrent que 96 % des avortements légaux en Pologne sont pratiqués pour ces motifs.
Loin de diminuer le nombre d’avortements, il mettra en danger la santé et la vie des femmes et violera les obligations internationales de la Pologne en matière de droits humains.
Il faut stopper ce nouveau projet, comme l’ont été ceux de 2011, 2013, 2015 et 2016 à la suite de mobilisations massives.
Le Collectif« Avortement en Europe, les Femmes décident » soutient le mouvement des femmes polonaises pour un droit fondamental, celui de choisir d’avorter légalement et en toute sécurité ! es Femmes décident » revendique le droit pour toutes les femmes d’Europe à disposer de leurs corps et à avoir accès à un avortement sûr et légal !

Nous sommes scancalisé.e.s par les tentatives incessantes pour faire reculer les droits reproductifs des femmes en Pologne.

S’il est adopté, ce projet de loi limitera encore davantage les motifs déjà très restreints qui permettent aux femmes d’accéder légalement à l’avortement en Pologne. Il mettra en danger la santé et la vie des femmes et violera les obligations internationales de la Pologne en matière de droits humains.

Nous appelons les membres du Parlement polonais à écouter les voix des femmes qui s’élèvent dans toute la Pologne et à rejeter cette proposition législative régressive, pour protéger la santé des femmes et les droits humains.

La loi Polonaise est déjà l’une des plus restrictives en Europe sur l’avortement. L’avortement n’est légal que dans trois cas : s’il y a danger pour la vie ou la santé des femmes, dans des situations de malformation fœtale grave ou lorsque la grossesse résulte d’un viol ou d’un inceste. Cependant, même dans les situations où l’avortement est légal, les femmes doivent faire face en pratique à de multiples obstacles. La dernière proposition de loi «Stop à l’avortement» vise à interdire l’avortement en cas de grave anomalie fœtale.

Si ce projet de loi est adopté, cela signifiera que les soins liés à l’avortement ne seront plus accessibles aux femmes polonaises lorsqu’une anomalie fœtale grave ou mortelle sera diagnostiquée. Les statistiques officielles de 2016 montrent qu’en pratique, 96% des avortements légaux en Pologne sont pratiqués pour ces motifs. La plupart des femmes qui décident de mettre fin à une grossesse à la suite d’un viol ou parce que leur santé est menacée n’ont de fait pas accès à l’avortement légal en Pologne et doivent aller à l’étranger pour le faire. Ce projet de loi constituera une entrave supplémentaire pour les femmes, notamment celles qui ont des faibles revenus et celles vivant en milieu rural, pour accéder à des services d’avortement sans risque.

Depuis 2011, le gouvernement polonais a lancé des attaques répétées contre les droits reproductifs des femmes. En 2011, 2013, 2015 et 2016, des propositions législatives ont été introduites pour limiter ou interdire quasiment l’avortement. À la suite de manifestations publiques massives, telles que les « black protests » en 2016, largement relayées et soutenues par des mouvements massifs dans plusieurs pays d’Europe, ces projets de loi ont été rejetés.

Interdire aux femmes l’accès à un avortement sûr et légal est contraire à plusieurs droits humains consacrés par le droit international, notamment le droit à la vie, l’accès à la santé et aux soins, à la non-discrimination et à l’égalité, à la protection de la vie privée et à la liberté de s’opposer à des traitements cruels, inhumains ou dégradants. De nombreux organes internationaux des droits humains, notamment le Comité des droits de l’homme des Nations Unies, le Comité des droits économiques, sociaux et culturels, le Comité pour l’élimination de toutes les formes de discrimination à l’égard des femmes (CEDEF) et le Comité contre la torture ont exhorté les gouvernements à lever les obstacles aux services d’avortement et à assurer l’accès à un avortement sûr et légal.

Polish Parliament Must Protect Women’s Health and Rights

We are deeply concerned by relentless attempts to roll back the reproductive rights of women in Poland.
This week Poland’s parliament is debating a new draft bill entitled “Stop Abortion.” If adopted, this legislation will further limit the already restricted grounds on which women can lawfully access abortion in Poland. It will place women’s health and lives at risk and violate Poland’s international human rights obligations.

We call on Members of Poland’s Parliament to listen to the voices of women across Poland and to reject this regressive legislative proposal and protect women’s health and human rights.
Poland already has one of Europe’s most restrictive abortion laws. Abortion is only lawful to safeguard the life or health of women, in situations of severe fetal anomaly or where the pregnancy results from rape or another criminal act such as incest. Even in those situations in which abortion is legal, multiple barriers combine to limit women’s access in practice. The latest “Stop Abortion” proposal seeks to ban abortion in situations where there is a severe fetal anomaly.

If the “Stop Abortion” bill is passed it will mean that abortion care will no longer be available to women in Poland when they receive a diagnosis of a severe or fatal fetal anomaly. Official statistics from 2016 show that in practice 96% of legal abortions in Poland are performed on these grounds. Most women in Poland who decide to end a pregnancy resulting from rape or because their health is at risk are unable to access legal abortion care in Poland and must travel outside the country to do so. This bill would further hinder women, particularly those from low-income and rural communities, from accessing safe abortion care.

Since 2011, Poland’s government has launched repeated attacks on women’s reproductive rights. In 2011, 2013, 2015 and 2016 draft legislative proposals were introduced that contained total or near total bans on abortion. Following massive public protests, such as the Black Protests in 2016, these draft bills were defeated.

Prohibiting women from accessing safe, legal abortion violates a number of human rights enshrined in international law, including the rights to life, health and health care, nondiscrimination and equality, privacy, and freedom from cruel, inhuman or degrading treatment. The European Court of Human Rights has previously ruled that the Polish government, in hindering timely access to abortion, has violated women’s rights under the European Convention on Human Rights. Numerous international human rights bodies, including the UN Human Rights Committee, the Committee on Economic, Social, and Cultural Rights, the Committee on the Elimination of all Forms of Discrimination against Women, and the Committee Against Torture, have called on governments to remove barriers to abortion services and ensure access to safe and legal abortion.
